Welcome to BigUp! These Terms of Service ("Terms") are the rules you agree to follow when you use our mobile app, "BigUp" or "BigUp Yourself" ("App"). Spiel chat, Inc. ("BigUp," "BigUp Yourself," "us," "we," or "our") owns and operates the App. By using the App, you accept these Terms. If you don't agree, please don't use the App.

1. Who Can Use the App

  • You must be at least 13 years old to use the App. If you're under 13, you may not use it, even with permission.
  • You need an account to access most features. Sign in with your Google or Apple ID. Keep your login credentials secure—we're not responsible if someone else uses them.

2. What You Can Do

  • Voice Cloning: Record or upload a sample to clone your voice for personalized affirmations.
  • Listen to Affirmations: Access a library of TTS-generated audio files and receive daily new affirmations if subscribed.
  • Premium Features: Subscribe for daily new affirmations and library access.

3. Credit System

In addition to daily affirmations, BigUp uses a credit system for creating custom audio affirmations. Here's how it works:

  • Credit Allocation: Premium subscribers receive 8 credits per week. Credits are automatically added to your account on a weekly basis while your subscription is active.
  • Using Credits: Credits are used to create personalized audio affirmations. The cost per audio creation is subject to change at our discretion, and we will notify you of any significant changes.
  • Access Without Premium:
    • If your premium subscription lapses or is cancelled, you will lose access to creating new audio affirmations.
    • You will also lose access to all previously created audio content when your premium subscription ends.
    • Any unused credits will remain in your account and can be used if you resubscribe to premium.
  • Credit Management: We reserve the right to modify, suspend, or remove credits from user accounts at our sole discretion, including but not limited to cases of suspected abuse, violations of these Terms, or technical issues.
  • Account Deletion: If you delete your BigUp account, your entire credit balance will be permanently deleted along with all other account data. Credits cannot be transferred, refunded, or recovered after account deletion.
  • No Cash Value: Credits have no cash value and cannot be exchanged for money, transferred to other users, or redeemed outside of the App.

4. Rules for Using the App

  • Your Content:

    You may only upload voice recordings that you own or have full permission to use. By uploading content, you confirm that you have all necessary rights and permissions.

    You are solely responsible for any content you upload, and you agree to indemnify and hold harmless BigUp from any claims, damages, or legal actions arising from your content.

    We reserve the right to remove any content at our sole discretion without notice if we believe it violates these Terms, infringes on someone else's rights, or is otherwise inappropriate.

  • Behavior: Don't cheat, hack, or tamper with the App. Don't misuse the features.
  • Payments: If you purchase premium features, you agree to pay through our payment provider, RevenueCat. Payments are final unless otherwise stated.

5. Our Rights

  • Content Ownership: You retain ownership of your voice recordings, but you grant us permission to use them for creating affirmations.
  • App Ownership: We own the App, its design, and its code. You are granted a limited license to use the App under these Terms.
  • Changes: We may update the App or these Terms at any time. We'll notify you of significant changes (for example, via email or in-app notices). Continuing to use the App means you accept the updated Terms.
  • Banning: We can suspend or terminate your account if you violate these Terms, cheat, or upload inappropriate content. We may do this without prior warning.

6. Privacy

  • We collect information like your login ID, voice recordings, and preferences. See our Privacy Policy for full details on how we handle and protect your information.

7. Limits on Responsibility

  • We provide the App "as is." We're not responsible for crashes, lost data, or performance issues.
  • Audio creations may include errors or inaccuracies due to the nature of text-to-speech software.
  • We are not liable for any damages arising from your use of the App, except as required by law.

8. Ending Your Use

  • You can stop using the App anytime by deleting it from your device.
  • We may suspend or terminate your access at our discretion if you violate these Terms or if the App is discontinued. We'll attempt to notify you if possible.
